These terms and conditions, and any specific product terms and conditions shown on this website, constitute the terms of our agreement with you. By purchasing goods through TelstraClearShop you accept these terms and conditions.

References to "you" or "your" refer to you, the Customer; references to “TelstraClearShop” “we” “us” or “our” refer to TelstraClear Limited.

These terms and conditions and all prices displayed on the site are subject to change without notice. The terms and conditions that are displayed on this website and in force at the time you place your order shall govern that order.

You consent to receive electronic records, including tax invoices and statements which may be provided via a web browser or sent via e-mail to the email address provided by you. You may withdraw consent to receiving electronic records or have the records provided in non-electronic form by contacting the Support Team at the address provided below.

General Requirements

To make a purchase from the TelstraClearShop:

  1. you must be 18 years of age or over, or if you are under 18 years of age, you must have your parent or guardian's consent to make the purchase and enter into these terms and conditions;
  2. you must be either purchasing on your own behalf or authorised to purchase on behalf of another person;
  3. you must specify a delivery address in New Zealand; and
  4. you must be buying for your own use and not for resale.

If you are purchasing on behalf of a registered company, association, partnership or other such entity:

  1. you must be authorised to agree to these terms and conditions on behalf of that entity;
  2. you must be authorised by that entity to make the purchase;
  3. delivery of the product(s) ordered must be to the entity's address in New Zealand; and
  4. references in these terms and conditions to "you" include that entity.

By purchasing from the TelstraClearShop, you warrant that you meet the relevant conditions set out above.

Pricing and Information Disclaimer

All pricing is subject to change. All prices are in New Zealand Dollars and are inclusive of GST. All products listed are subject to availability. Freight and handling costs are included for some items and they are clearly displayed.

We reserve the right to refuse to accept any order at any time. No order is accepted until goods are dispatched or acceptance is communicated to you, whichever is the earlier.

While TelstraClearShop uses reasonable efforts to include accurate and up-to-date information on the site, we make no warranties or representations as to the site's accuracy and assume no liability or responsibility for any errors or omissions in the content on the site.

Delivery Times

TelstraClearShop will use its best endeavours to ensure that goods are delivered to you within any timeframes or estimates given, however, we will not be responsible or liable to you for any delay or failure to meet these timeframes for any reason.

Title

Title to all goods sold shall remain with us until payment is received in full.

Return Policy

TelstraClearShop may, but is not obliged to, accept the return of any product that was ordered and correctly supplied without defect or damage on a “change of mind” basis, in which case a handling fee may apply. Refunds on change of mind returns do not apply to Video games, DVD’s or Computer Software. Please contact the Support Team for more information.

You may exercise your rights under the Consumer Guarantees Act 1993 at any time unless you use, or have indicated to us that you will use, the goods for business purposes. Please contact the Support Team for more information or to arrange the return of any products.

Condition of goods returned

All products returned must be 100% complete, contain all original boxes and packing materials, have original UPC codes on the manufacturer boxes, contain all manuals, blank warranty cards and other accessories and documentation provided by the manufacturer. We can only accept product returns which are unmarked, and in original condition.

Damaged On Arrival

If a product is delivered in a damaged condition, it is best to REFUSE delivery. If a product is delivered incorrectly or with defects or damage, you must notify us within 24 hours of receipt of the product. If you accept the package make sure it is noted on the carrier's delivery record that the product was damaged, in order for TelstraClearShop to file a damage claim. Save the goods and the original box and packing it arrived in, notify us immediately to arrange for a carrier inspection and a pick up of damaged goods. Any item that is damaged can only be replaced with a similar item. If you do not notify TelstraClearShop of damaged goods within 24 hours of receipt, our regular return policy will override any claim of damage.

Courier Charge

You are responsible for all shipping, handling and freight charges at all times, unless exercising your rights under the Consumer Guarantees Act 1993.

Insurance

TelstraClearShop strongly recommends you fully insure your return shipment in case it is lost or damaged and you use a carrier that can provide you with proof of delivery for your protection.

Variation

TelstraClearShop reserves the right to modify and vary these terms and conditions and any prices displayed on this site at any time.

Non Waiver

If TelstraClearShop fails to enforce any terms or to exercise its rights under these terms and conditions at any time, TelstraClearShop has not waived those rights.

Limitation of Liability and General Disclaimer

Subject to our obligations under the Consumer Guarantees Act 1993, TelstraClearShop makes no warranty or representations as to the quality, suitability or fitness for purpose of any product depicted on this site. Our liability to you shall be limited to the value of any products or service supplied. We shall not be liable for any loss or delay caused by the carrier.

Any warranty claims should be addressed to the manufacturer in the first instance.

TelstraClearShop will not be liable for any losses of any kind or any delay in performing obligations caused by circumstances beyond our control including any natural disaster, flood, earthquake, strike, lockout, fire, war, civil commotion, network service failure, inability to obtain products or supplies including the imposition of any export or import bans, or any other cause beyond its reasonable control.

Privacy

All personal information you provide to us will be dealt with in accordance with our Privacy Policy and the Telecommunications Information Privacy Code 2001.

Compliance with New Zealand Laws

These terms and conditions are governed by the laws of New Zealand and the parties agree to submit to the non-exclusive jurisdiction of the Courts of New Zealand.
